Separate historical trustees (Section 5) from current signing trustees (declaration) on the Family Trust Election form
Section 5 of the FTE form requires all trustees of the trust since the proposed commencement of the election. That date can be several years back, and the list may include former trustees. The declaration only needs the current trustee(s), who sign the form.
At the moment, Xero Tax uses the same trustee data for both sections. You can’t remove a former trustee from the declaration without also removing them from Section 5. This means one of two things happens:
Section 5 ends up incomplete, or
the declaration lists people who aren’t current trustees and won’t be signing.
This matters most when trustees have changed and the former and current responsible people are different.
Request: manage Section 5 trustees and declaration signatories separately. For example, add a “current trustee / signatory” flag for each trustee, or keep a separate declaration trustee list that defaults from current trustees but can be edited on its own.
